What happens if I don’t comply with the Regulations?

Failure to manage risks can lead to enforcement action by the Fire Authorities, who are obliged to ensure compliance with the Regulations. They may issue a notice, and in severe cases, penalties may include a fine of up to £5000 per offence upon summary conviction in a Magistrates Court.

Further consequences could include an unlimited fine, up to two years imprisonment, or both upon conviction in a Crown Court. Fines reaching up to €400,000 and imprisonment have been issued in certain cases.

Are fire risk assessments required annually?

The frequency of fire risk assessments depends on the type of property and its use. We recommend an assessment is reviewed regularly, this can be done by a competent person on the premises. As a general rule, we would say review annually by a fire risk assessor.

If the premises is very low risk, you could review biennially or three-yearly, but no later. It must be reviewed within that time to ensure nothing has changed.

A fire risk assessment identifies potential fire hazards, evaluates the risk, and suggests measures to mitigate these risks. It’s necessary for ensuring safety, legal compliance, and protecting people and property from fire hazards.

How long does a fire risk assessment take?

The duration varies depending on the size and complexity of the premises.

What are the legal requirements for a fire risk assessment?

The legal framework for fire safety in the UK is primarily governed by the Regulatory Reform (Fire Safety) Order 2005, the Fire (Scotland) Act 2005, and the accompanying Fire Safety (Scotland) Regulations 2006. These laws have superseded over 70 individual pieces of fire safety legislation.

Legally, you are required to conduct a fire risk assessment and implement suitable fire safety measures based on the findings of the assessment to minimise the risk to life from fire. 

Can a fire risk assessment identify all the potential fire hazards?

It aims to identify as many risks as possible, but absolute identification of all hazards is challenging. Regular assessments help in identifying new risks.

 Trustindex verifies that the original source of the review is Google. The assessor really knew her stuff and was friendly, but professional. However this is a converted house with four flats and I feel that the resulting paperwork was complicated and very wordy. The freeholders manage the building themselves so perhaps should have engaged a company that could also do the necessary work. If you are a larger block/ company I would recommend them. This review originally appeared on Trust pilot and I had a reply saying that the report section summarises the information, that is of course correct, however, it could do with being in a better format for printing.
